7 Brew Gift Card Terms and Conditions

These 7 Brew Gift Card Terms and Conditions (referred to as the “Agreement”) describe the terms and conditions that apply to the purchase, acceptance, and use of 7 Brew physical gift cards (“Gift Cards”). This Agreement is between you, the Cardholder, and Brew Culture, LLC (doing business as 7 Brew Drive Thru Coffee), and its affiliates, subsidiaries, and related entities (“7 Brew,” “we,” “us,” and “our”). Please read this Agreement carefully before purchasing, accepting, or using a Gift Card.
By purchasing, accepting, or using a Gift Card, you accept the terms of this Agreement, as revised from time to time, as well as the 7 Brew Online Services Terms and Conditions of Use and Privacy Notice, and agree to be bound by this Agreement. If you do not agree with this Agreement, do not purchase, accept, or use a Gift Card.
By accepting the terms of this Agreement, as described in Section 13 below, you agree to resolve any dispute in any way arising or relating to the terms of this Agreement through binding arbitration, and you agree to waive your right to resolve disputes through any other processes that may be available to you and your rights to a trial by jury and to participate in a class action suit.
7 Brew reserves the right to make changes to this Agreement at our sole discretion, with or without notice. Notice of these changes will be given by reasonable means, including by posting the revised version of this Agreement on this website (the “Updated Terms”). The Updated Terms will be effective as of the date of posting. Your use of a Gift Card after the Updated Terms are posted constitutes your acceptance of such changes. We encourage you to check this Agreement periodically for changes.
- About Your Card. Gift Cards are closed-loop gift cards issued in U.S. dollars that may be used at participating 7 Brew or 7 Brew franchise locations.
- Liability. The balance on any Gift Card is solely the liability of 7 Brew.
- No Expiration; No Fees. Gift Cards do not expire. No fees for inactivity or service fees apply to any Gift Cards.
- Purchasing Cards. Gift Cards may be purchased at participating 7 Brew or 7 Brew franchise locations, online at 7brew.com, or at authorized resellers.
- No Refunds. Gift Cards are not refundable or redeemable for cash unless required by applicable law. You may not return or cancel your Gift Card after it is received.
- Redemption. Gift Cards are redeemable only for purchases of eligible goods and services at participating 7 Brew or 7 Brew franchise locations. Eligible goods and services are subject to change without notice in 7 Brew’s sole discretion.
- Balance. You may check your Gift Card balance by visiting https://rewards.7brew.com/giftcard, entering you card number and registration code, then selecting “Check Balance” or by visiting your local stand.
- Reloading. Gift Cards may be reloaded with additional value at participating 7 Brew and 7 Brew franchise locations. Reloaded amounts are not refundable or redeemable for cash except as required by applicable law.
- Lost, Damaged, or Stolen Cards; Unauthorized Use. Lost, damaged, or stolen gift cards may be replaced at 7 Brew’s sole discretion, provided that you present original proof of purchase for the purchase or reload of the Gift Card. You are solely responsible for all transactions associated with your card, whether authorized or unauthorized. You should safeguard your Gift Card and not disclose your Gift Card information to anyone. 7 Brew is not responsible for any unauthorized use of your Gift Card.
- Promotional Use. 7 Brew prohibits the use of Gift Cards in promotional, marketing, or advertising activities through the Internet, radio, magazine, direct mail, email, newspaper, television broadcast, or similar mediums. In certain circumstances, 7 Brew, in its sole discretion, may provide prior written approval for a promotional program.
- Resale Prohibited. You may not sell or exchange a Gift Card for cash or otherwise barter or trade a Gift Card. Gift Cards obtained from unauthorized sellers or resellers will not be honored.
- Fraud/Violation of Terms. 7 Brew reserves the right to refuse to honor, or to suspend or deactivate one or more Gift Cards where 7 Brew suspects that a Gift Card was obtained fraudulently, in violation of this Agreement, or in violation of applicable laws or other applicable 7 Brew terms and conditions. 7 Brew further reserves the right to temporarily cease the sale or redemption of some or all Gift Cards without prior notice to you in the event 7 Brew has detected or suspects a fraudulent attach on its systems or has otherwise identified an issue that may impact the Cards.
- Arbitration. Please read this section carefully, as it affects your legal rights. This section requires you to arbitrate disputes with 7 Brew and limits the manner in which you may seek legal relief.
Agreement to Arbitrate
Any dispute, controversy, or claim arising out of or related in any manner to this Agreement or the 7 Brew Online Services Terms and Conditions of Use and 7 Brew’s Privacy Notice, including your purchase, acceptance, or use of Gift Cards offered or sold by 7 Brew or its franchisees (collectively, a “Dispute”) shall be solely and finally settled by individual binding arbitration administered by the American Arbitration Association (AAA) by a sole arbitrator in accordance with the rules of the AAA, including the AAA’s Consumer Arbitration Rules, if applicable (the “AAA Rules”), as modified by this arbitration agreement. The AAA Rules are available at www.adr.org. If there is any conflict between the AAA Rules and this Agreement, this Agreement will govern. You and we agree that this Agreement affects interstate commerce and, accordingly, the Federal Arbitration Act, 9 U.S.C. §§ 1-16, not state law, applies to the interpretation and enforcement of this arbitration agreement.
Pre-Arbitration Procedures
Before initiating any Dispute, you must give us at least 60-days’ written notice of the Dispute that contains enough information for us to attempt to resolve your Dispute, including (a) your name; (b) your email address and telephone number; (c) a written description of the problem, relevant documents, and supporting information; (d) a good faith calculation of the damages you claim to have suffered; and (e) a description of the relief you intend to seek. You and we agree to negotiate any Dispute between us in good faith during this 60-day period, during which time neither you nor we may commence any arbitration proceedings (the “Resolution Process”). If you and we are unable to reach a resolution of the Dispute during the Resolution Process, following the expiration of the 60-day period, either party may initiate arbitration proceedings in accordance with this arbitration agreement. You may be represented by an attorney or other person during the Resolution Process, but we may require that you submit written authorization allowing us to discuss your Dispute with your attorney or other representative.
Arbitration Procedures
To initiate arbitration, you must make a written demand requesting arbitration to the AAA and to us at the following address: Brew Culture, LLC, 2710 S. 48th Street, Springdale, Arkansas 72762.
Payment of all filing, administrative, and arbitrator fees will be governed by the AAA Rules. The arbitration shall be held at a location determined by the AAA under its rules and procedures or at such other location as may be mutually agreed upon by the parties. Unless doing so would violate applicable law, the arbitrator shall apply Arkansas law consistent with the Federal Arbitration Act.
The arbitrator will have the power to grant the same relief that would be available in a court under law or in equity and any award of the arbitrator will be final and binding on each of the parties and may be entered as a judgment in a court of competent jurisdiction.
- Waiver of Class Actions and Jury Trial. Please read this section carefully, as it affects your legal rights. This section contains a jury trial waiver and a waiver of any and all rights to proceed in a class action to the fullest extent allowed under applicable law.
Waiver of Class Actions
You and we each agree that you may only initiate claims in your individual capacity and not in any representative capacity or on behalf of any class or purported class. No proceedings commenced under this Agreement, whether in arbitration or in a court of law or in equity, may be joined with or include any other parties or claims by other parties.
Waiver of Jury Trial
To the fullest extent allowed by applicable law, you and we each waive the right to a jury trial, instead electing that all claims shall be resolved by arbitration as set forth herein.
- Limitation of Liability. 7 Brew makes no warranties, express or implied, with respect to the Gift Cards, including, without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. In the event that a Gift Card is non-functional, your sole remedy and 7 Brew’s sole liability shall be the replacement of such Gift Card. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply to you. Unless prohibited by law, you and 7 Brew agree to limit claims for damages or other monetary relief against each other to direct and actual damages and that neither you nor 7 Brew will seek any indirect, special, consequential, treble, or punitive damages from the other.
- Governing Law. Without regard to choice-of-law principles, the laws of the State of Arkansas shall apply to this Agreement and the use of Gift Cards.
- No Waiver. The failure of 7 Brew to exercise or enforce any right or provision set forth under this Agreement or under applicable law shall not operate as a waiver of such right or provision. Any waiver of the terms of this Agreement by 7 Brew must be in writing and signed by an authorized representative of 7 Brew.
- Severability. If any provision of this Agreement is found to be invalid, the remaining provisions shall remain in full force and effect.
- Entire Agreement. This Agreement, together with the 7 Brew Online Services Terms and Conditions of Use and Privacy Notice, constitute the entire agreement between us and you with respect to Gift Cards and all related programs, features, and services. This Agreement shall bind you and us and each of our heirs, successors, and assigns from and after the “Last Revised” date set forth at the top of this Agreement.
